Juiz responsável pela decisão? Tourinho Neto. Três dias atrás, Tourinho Neto tomou também a primeira decisão para, eventualmente, sacramentar a morte da Operação Monte Carlo. Relator de um pedido de habeas corpus apresentado por Thomaz Bastos, ele considerou as escutas ilegais.
Segundo Tourinho Neto, o delegado encarregado da investigação, Matheus Mella Rodrigues, fundamentou o pedido de interceptações em denúncias anônimas. "Não se pode haver a banalização das interceptações, que não podem ser o ponto de partida de uma investigação, sob o risco de grave violação ao Estado de Direito", disse ele. O julgamento será retomado na terça-feira e se os demais magistrados acompanharem o relator, o trabalho dos policiais será atirado no lixo. Curiosamente, Cachoeira, notório por sua indústria de grampos ilegais, tenta se safar questionando a legalidade dos grampos da polícia.
Tourinho Neto também tomou outra decisão favorável a Cachoeira, no dia 13 deste mês, ao mandar desbloquear os bens do laboratório farmacêutico Vitapan, que está em nome de sua ex-mulher, Adriana Aprígio – o pagamento dos honorários de Thomaz Bastos passa pela indústria farmacêutica de Anápolis (GO).
Tourinho Neto é desafeto da ministra Eliana Calmon, corregedora do Conselho Nacional de Justiça, e é também visto com ressalvas por certas alas da Polícia Federal e do Ministério Público.
